Rhoderie Estrada, 41-year-old nurse, was found murdered in her bed. When her husband came home from work, he found Rhoderie lying in their bed, with severe blunt-force head trauma. Two men initially broke into her home to steal valuables but found Estrada alone in the bedroom and decided to sexually assault her. In the course of sexually assaulting and forcibly confining Estrada, they repeatedly hit her in the head with metal bars breaking every bone in her face. Yostin Murillo and David Beak were found guilty of the first-degree murder and sexual assault of Estrada. Murillo claimed he alone beat Estrada to death in an unexpected and unplanned attack, but argued he was too intoxicated on alcohol and meth to have the state of mind for murder and that he should be found guilty of manslaughter. Beak testified he did not participate in killing Estrada, that he tried to “have sex” with her after she was already clearly dead. Legally, a sexual assault cannot be committed on a person who is dead. Murillo claimed he left the room and did not know what Beak was going to do.
